Terms of Use (pre-release)
These terms are an agreement between you and Sidetrack (pre-release) ("Sidetrack", "we") for using the Sidetrack app and sidetrack.link (the "Service"). By creating an account or using the Service you agree to them, and to our Privacy Policy. If you don't agree, please don't use Sidetrack.
1. A pre-release service
Sidetrack is in testing. Features may change, break or go away, and data may be reset. Please tell us about problems at hello@sidetrack.link.
2. Who can use Sidetrack
You must be at least 13 years old. People aged 13 to 17 get stricter sharing defaults. You're responsible for your account and for what happens on it, and you agree to give us accurate information.
3. Your circle and what you share
- Your circle is up to 25 people who have each agreed to be in it. While sharing is on, they see what you play and the moments you choose to share.
- You decide what's shared: you can pause or turn off sharing, hide your listening from anyone, and remove people at any time.
- Notes you write (up to 280 characters, shown to your circle or only to you, as you choose) and songs you pass on are yours. You give us permission to store them and show them to the people you share them with, only to run the Service.
- Anyone who has a pass link you made can see the song and your first name and claim it once within 7 days. Only share pass and invite links with people you want to have them.
- You can block anyone and report people, songs, notes or passes. We may remove content or close accounts that break these terms.
4. Using Sidetrack fairly
Don't use Sidetrack to harass, threaten or impersonate anyone; to break the law or someone else's rights; to send spam; to collect other people's data, including their phone numbers or contacts; or to interfere with, scrape, overload or get around the security of the Service.
5. Music services
Sidetrack doesn't host music. Songs are played by Apple Music, or by Spotify if you connect it, and your use of those services is governed by their own terms. Connecting a music service lets Sidetrack read your listening as described in the Privacy Policy. Spotify support is an experimental beta for a few invited testers and may not be part of the public release. Songs from Spotify are shown with Spotify's own artwork and branding, open in Spotify, and aren't used for your Five, Sunday Sidetracks or other taste features.
6. Spotify
If you connect Spotify or see content from Spotify in Sidetrack, these terms also apply. Here, "Spotify Platform", "Spotify Service" and "Spotify Content" have the meanings given in the Spotify Developer Terms.
- No warranties from Spotify. Sidetrack doesn't make any warranties or representations on behalf of Spotify, and expressly disclaims all implied warranties with respect to the Spotify Platform, Spotify Service and Spotify Content, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement.
- No derivative works. You may not modify or create derivative works based on the Spotify Platform, Spotify Service or Spotify Content.
- No reverse engineering. You may not decompile, reverse-engineer, disassemble, or otherwise reduce the Spotify Platform, Spotify Service or Spotify Content to source code or other human-perceivable form, to the full extent allowed by law.
- Spotify isn't liable. Sidetrack is responsible for Sidetrack. Spotify and other third parties are not liable to you for anything to do with Sidetrack, and we disclaim any liability on their part.
- Spotify can enforce these terms. Spotify is a third-party beneficiary of these Terms of Use and of our Privacy Policy, and is entitled to directly enforce these Terms of Use.
Why this section is here: the Spotify Developer Terms (Version 10, effective as of 15 May, 2025), Section V (Users & Data), paragraph 11 (cited as V.11), say:
"You must display and require end users to agree to an enforceable end user agreement reflecting at least the following minimum terms:
- not make any warranties or representations on behalf of Spotify and expressly disclaim all implied warranties with respect to the Spotify Platform, Spotify Service and Spotify Content, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement;
- prohibit modifying or creating derivative works based on the Spotify Platform, Spotify Service or Spotify Content;
- prohibit decompiling, reverse-engineering, disassembling, and otherwise reducing the Spotify Platform, Spotify Service, and Spotify Content to source code or other human-perceivable form, to the full extent allowed by law;
- state that you are responsible for your products and disclaim any liability on the part of third parties (e.g., Spotify);
- state that Spotify is a third party beneficiary of your end user license agreement and privacy policy and is entitled to directly enforce your end user license agreement."

7. Notifications
If you allow them, we send push notifications for things like passes, people joining your circle and your weekly Sunday Sidetrack. You can turn each type off in Settings › Notifications.
8. Our content and yours
The Sidetrack app, name, design and website belong to us. Song titles, artwork and other music metadata belong to their owners and are shown as provided by Apple Music or Spotify. You keep the rights to what you write. Don't copy, modify or reverse-engineer the Sidetrack app except where the law allows it.
9. No warranty
Sidetrack is provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. We don't promise that it will always work, be error-free, or that your circle will see every song you play.
10. Limits on our liability
To the fullest extent the law allows, Sidetrack won't be liable for indirect, incidental, special or consequential damages, or for lost data or profits, arising from your use of the Service. Some places don't allow these limits, so they may not apply to you.
11. Ending things
You can stop using Sidetrack and delete your account at any time (Settings › Delete account, or see sidetrack.link/delete). We may suspend or close accounts that break these terms or put others at risk. Sections 6, 8 to 10 and 12 survive.
12. Changes and the law that applies
We'll update these terms as Sidetrack moves toward launch, change the date above, and tell you in the app if a change is significant. The governing law will be set out here before public launch.
